Abstract
The Court of Arbitration for Sport (CAS) has established itself as the world’s leading judicial forum for settling global sports disputes. The effectiveness and fairness of CAS are examined in this paper, considering whether1 CAS produces predictable and balanced results for all stakeholders. Employing a doctrinal and qualitative case study methodology, the research examines relevant literature, conducts analyses of major CAS decisions, and considers stakeholder opinion. Findings are that although CAS has established a consistent system of dispute settlement, issues persist with regards to arbitrator impartiality, athlete access, and procedural fairness. This paper recommends focused changes designed to improve the legitimacy and fairness of CAS proceedings.
